FrikaSocial — operated by Frikatek Technologies

By creating a FrikaSocial account or using our service, you agree to these Terms of Service. Please read them carefully.

1. What FrikaSocial Does

FrikaSocial is a service operated by Frikatek Technologies that lets you post photos and videos to your Instagram Business Account by sending them to our WhatsApp bot. The service includes:

• A web dashboard for connecting your Instagram account and managing settings
• A WhatsApp bot that receives your media and posts it to Instagram
• AI-generated captions based on your settings
• Optional scheduling for posting at chosen times

2. Who Can Use FrikaSocial

To use FrikaSocial you must:

• Be at least 18 years old
• Operate a legitimate business
• Have a valid Instagram Business or Creator account
• Have a Facebook Page linked to that Instagram account
• Comply with Instagram's Terms of Use and Community Guidelines
• Comply with WhatsApp's Terms of Service
• Comply with the laws of Tanzania and your jurisdiction

3. Your Account

You are responsible for:

• Keeping your password confidential
• Not sharing your account credentials
• All activity that happens through your account
• Maintaining the security of the email address you signed up with

If you suspect unauthorized access, email admin@frikasocial.online immediately.

4. Your Content

You retain all rights to the photos, videos, and captions you create and post through FrikaSocial. We do not claim ownership of your content.

By using FrikaSocial, you grant us a limited license to:

• Process your content for the purpose of posting it to your Instagram account
• Store your content temporarily during processing
• Use AI to generate captions based on your instructions and settings

You confirm that

• You own or have rights to all content you upload
• Your content does not violate any laws or third-party rights
• Your content complies with Instagram's Community Guidelines

You may NOT use FrikaSocial to post

• Illegal content
• Hate speech, harassment, or threats
• Sexually explicit content
• Content that infringes copyright or other intellectual property
• Spam or repetitive low-quality content
• Misleading content (such as deepfakes presented as real)
• Content promoting violence, self-harm, or dangerous activities

We may remove content or suspend accounts that violate these rules.

5. The WhatsApp Bot

Our WhatsApp bot uses a shared business phone number provided by Meta's WhatsApp Business Platform. When you message the bot:

• Your messages and media are processed to fulfill your posting requests
• The bot responds with confirmations, caption previews, and approval requests
• You must approve each caption before it is published to your Instagram
• You can cancel any pending post by replying "hapana" or "cancel"

The bot is automated. We do not read your conversations except for service quality, debugging, or as required by law.

6. Instagram Connection

When you connect your Instagram account, you grant FrikaSocial permission (via Meta's OAuth flow) to:

• View your basic Instagram account information
• Publish content to your account on your behalf
• See which Facebook Pages you administer
• Read basic engagement information (for analytics, when applicable)

You can disconnect your Instagram account at any time from the FrikaSocial dashboard or by revoking access in your Meta account settings.

7. Service Availability

We aim to provide reliable service, but we do not guarantee uninterrupted availability. The service may be unavailable due to:

• Maintenance or updates
• Issues with third-party providers (Meta, Cloudinary, OpenAI, Appwrite)
• Internet outages or force majeure events

We are not liable for missed scheduled posts or delays caused by service interruptions.

8. Pricing and Payment

If FrikaSocial offers paid plans, the pricing terms will be presented at signup or upgrade. You agree to pay all fees for plans you select. Fees are non-refundable except as required by law.

We may change pricing with at least 30 days' notice for existing users.

9. Prohibited Uses

You may NOT:

• Use FrikaSocial to violate any law or third-party rights
• Attempt to access another user's account
• Reverse engineer, decompile, or attempt to extract our source code
• Use the service to send spam or unauthorized commercial messages
• Resell or redistribute the service without our written permission
• Attempt to disrupt or overload our systems
• Use automated tools to register accounts or interact with the service in unauthorized ways
• Use the service to manipulate Instagram metrics or engagement

We may suspend or terminate accounts that engage in these activities.

10. Intellectual Property

The FrikaSocial name, logo, website, software, and design are owned by Frikatek Technologies. You may not use them without our permission, except for normal references to our service.

11. Disclaimers

The service is provided "as is" without warranties of any kind.We do not guarantee:

• That posts will always be published successfully
• That AI-generated captions will be accurate, appropriate, or effective
• That the service will be free of errors or interruptions
• That your Instagram account will not be affected by changes in Meta's policies

You use the service at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, Frikatek Technologies is not liable for:

• Indirect, incidental, or consequential damages
• Loss of revenue, profits, or business opportunities
• Damages caused by Instagram or WhatsApp policy changes or account suspensions
• Damages exceeding the amount you paid us in the 12 months before the claim

Some jurisdictions do not allow these limitations; in those cases, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify Frikatek Technologies against any claims, damages, or expenses arising from:

• Your use of the service
• Content you post through the service
• Your violation of these Terms
• Your violation of any law or third-party right

14. Suspension and Termination

We may suspend or terminate your account if:

• You violate these Terms
• You violate Instagram, WhatsApp, or other third-party platform rules
• Your account is being used fraudulently
• We are required to by law

You may delete your account at any time. See our Data Deletion page for details.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will email you and update the "Last updated" date. Continued use of FrikaSocial after changes means you accept the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the United Republic of Tanzania. Any disputes will be resolved in the courts of Tanzania.
